Welcome to Nous Nails. Nous Nails (“we,” “us,” “our”) is the operator of this website. By accessing or purchasing from our website (www.nousnails.com), you agree to the following terms and conditions. Please read them carefully. 1. General Overview

Nous Nails is a U.S.-based business operating out of Texas. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You agree to use our website and products solely for lawful purposes. We reserve the right to refuse service, cancel orders, or terminate accounts at our sole discretion, including for suspected fraud, unauthorized resale, or violations of these Terms.

2. Product Information & Availability

We make every effort to display product colors, details, and pricing as accurately as possible. However, actual colors may vary depending on your monitor settings.

All product drops and designs are subject to limited inventory and availability changes without prior notice. We reserve the right to modify prices, discontinue products, or limit order quantities at any time.

3. Orders & Payments

Payments: All purchases must be paid in full at checkout via our authorized payment processors (Shopify Payments, PayPal, Apple Pay, etc.). Nous Nails does not store full payment card details.
Order Adjustments: We reserve the right to refuse, limit, or cancel any order placed with us for any reason (e.g., inaccurate pricing, inventory stockouts, or suspected fraudulent activity).
Subscriptions: If you enroll in a recurring subscription, you authorize Nous Nails to store a secure payment token and automatically bill your designated payment method on the recurring schedule selected. You may modify or cancel your subscription at any time prior to your next billing cycle via your account portal or by emailing hello@nousnails.com.

4. SMS/MMS Marketing

SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS We are offering a mobile messaging program (the "Program"), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and Privacy Policy (the "Agreement"). By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the "Dispute Resolution" section below. This Agreement is limited to the program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts. The Program allows users to receive SMS/MMS mobile messages by affirmatively opting into the program, such as through online or application-based enrollment forms. Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the program. By participating in the program, you agree to receive automated or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from Us. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system ("ATDS" or "autodialer"). If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to reply STOP to any mobile text message from Us in order to opt out of the program. You may receive an additional mobile message confirming your decision to opt-out. You understand and agree that the foregoing options are the only reasonable methods of opting out. You understand and agree that attempting to opt out by texting other words or verbally requesting one of our team members to remove you from our list is not accounted for as a reasonable means of opting out. You acknowledge that the message frequency is various and that consent is not a condition to purchase. The program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with us. You must have a wireless device of your own, be capable of two-way.

5. Shipping & Delivery

We currently ship exclusively within the United States. Shipping costs and estimated delivery times are calculated at checkout.
While we process orders promptly, Nous Nails is not responsible for shipping delays caused by carrier disruptions, incorrect address entry by the customer, severe weather, or other events beyond our reasonable control. Risk of loss and title for items pass to you upon delivery to the carrier.

6. Returns, Exchanges & Refunds

We accept returns within 14 days of delivery on unopened, unused items in original packaging. For the purposes of this policy, “unopened” means the original seal on the product box has not been broken, opened, or tampered with. Due to hygiene and safety reasons, we cannot accept returns or exchanges on any items where the box seal has been opened, broken, or altered in any way.

7. Product Safety & Medical Disclaimer

Nous Nails products are intended exclusively for external, cosmetic use. Always follow application, safety, and removal instructions carefully. Perform a patch test prior to full application if you have sensitive skin or allergies. If irritation, redness, or sensitivity occurs, discontinue use immediately and consult a healthcare professional. Keep all products out of reach of infants, children, and pets.

8. Intellectual Property

All content included on this website—including images, product names, graphic designs, logos, text, packaging, and branding—is the exclusive property of Nous Nails LLC and protected by United States copyright, trademark, and intellectual property laws. Unauthorized reproduction, distribution, or commercial use of our intellectual property is strictly prohibited.

9. User-Generated Content & Reviews

By submitting reviews, photos, videos, or tagging Nous Nails in social media content, you grant Nous Nails LLC a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and publish your content across our website, marketing emails, and social media channels. You represent that you own all rights to the submitted content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Nous Nails LLC, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your access to or use of our website or products. Our total liability for any claim arising out of these Terms or product purchases shall not exceed the actual amount paid by you for the product giving rise to the claim.

10. Affiliate Program & Rewards

Participants in our affiliate, referral, or loyalty programs must abide by separate program terms and guidelines. Nous Nails reserves the right to modify, suspend, or cancel any program at any time without prior notice.

11. Dispute Resolution, Governing Law & Class Action Waiver

Governing Law: These Terms and any disputes arising out of or related to your use of the website or purchases shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to conflict of law rules.
Binding Arbitration: Any legal dispute, claim, or controversy arising out of or relating to these Terms or your purchase shall be resolved through binding individual arbitration in Austin, Texas, rather than in court.
Class Action Waiver: YOU AND NOUS NAILS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING..
